Terms of Service
Last Updated & Effective Date: September 16, 2026
1. Acceptance & Scope of Agreement
Welcome to GitHub Acceleration Doctor ("the service" or "we"). These Terms of Service constitute a legally binding agreement between you and our service.
By visiting this site via web browser or executing commands that route through our proxy relay (such as git clone, wget, curl, or pip install), you confirm that you have read, understood, and agreed to be bound by all of these terms. If you do not agree with any part of these terms, you must immediately cease using the service.
2. Technical Nature & Non-Hosting Disclaimer
To establish clear technical and legal parameters, users acknowledge and agree that:
- Non-Storage & Non-Hosting Conduit: This service functions purely as a reverse network streaming relay proxy across global edge nodes. We do not store, host, generate, or publish any software source code, binaries, or artifacts.
- Upstream Origin: All relayed content is streamed in real time and verbatim from third-party public repositories across the Internet. We bear no responsibility for the accuracy, legality, or availability of upstream origin content.
- Public Utility Nature: This tool is provided free of charge to open-source engineers as a public community resource.
3. Acceptable Use Policy & Prohibited Conduct
You agree to use this service exclusively in compliance with all applicable laws, regulations, and open-source licenses. The following abusive activities are strictly prohibited:
- Malware Distribution: Relaying computer viruses, ransomware, trojans, spyware, exploit toolkits, or files designed to compromise system security.
- Infringing Material: Relaying content that infringes on third-party copyrights, trademarks, patents, trade secrets, or proprietary rights.
- Denial of Service Attacks & Abuse: Launching Distributed Denial of Service (DDoS), CC attacks, automated credential stuffing, or synthetic high-frequency traffic aimed at exhausting system resources.
- Unauthorized Commercial Resale: Reselling or packaging our public relay nodes into commercial paid services without authorization.
Violations of this policy will result in immediate termination of access, firewall IP blocks, domain blacklisting, and reporting to relevant enforcement authorities where appropriate.
4. Intellectual Property & Independence Notice
Independent Status: This service is an independent third-party developer tool. It maintains no corporate affiliation, endorsement, sponsorship, partnership, or agency relationship with Microsoft Corporation, GitHub, Inc., or any other commercial code hosting providers.
Trademark Attribution:
- Git is a registered trademark of the Software Freedom Conservancy.
- GitHub® and related emblems are registered trademarks of GitHub, Inc. (a Microsoft Corporation subsidiary).
- All third-party product names, logos, and trademarks referenced are used solely for technical description and nominative fair use. All intellectual property rights remain with their respective holders.
5. Notice & Takedown Requests (DMCA)
We respect intellectual property rights. Because our system does not store or host files and acts solely as an encrypted transit pipe:
- Primary Resolution: If you believe a file infringes your copyright, the most effective remedy is to submit a takedown notice directly to the upstream host platform. Once removed from the source, our relay cannot fetch or serve the file.
- Proxy-Level Blocking: Rightsholders or their authorized representatives may request proxy routing blocks for specific URLs by providing proof of ownership. We will promptly add such targets to our edge blacklist.
6. Disclaimer of Warranties
This service is provided on an "AS IS" and "AS AVAILABLE" basis. To the maximum extent permitted by applicable law:
- We disclaim all express or implied warranties, including but not limited to merchantability, fitness for a particular purpose, non-infringement, and continuous, error-free operation.
- We make no guarantees regarding uptime, transmission speed, or uninterrupted connectivity, and assume no liability for third-party network outages or upstream rate limits.
7. Limitation of Liability
To the fullest extent permitted by law, the administrators, contributors, and operators of this service shall not be liable for any direct, indirect, incidental, consequential, special, or exemplary damages—including but not limited to loss of profits, business interruptions, data corruption, or hardware damage—arising out of the use or inability to use this service.
8. Amendments & Severability
We reserve the right to revise or update these Terms of Service at any time. Revisions take effect immediately upon posting to this page.
Continued use of the service following amendments indicates your acceptance of the updated terms. If any provision is deemed unenforceable, the remaining provisions shall continue in full legal effect.
